PKWAT is published by Nendo, a French company. The legal notice says who that is and how to reach us. Using PKWAT means accepting what follows.
PKWAT is a poker game for private groups. The chips are play money. They cannot be bought, cannot be sold, cannot be cashed out, and have no value of any kind outside the club they sit in. There is no wagering here and no prize, and using PKWAT to run one is not allowed.
If real money changes hands between people who happen to play here, that is between them and their jurisdiction. It is not part of this service, it is not visible to it, and it is grounds for closing a club.
You have to be at least 18 to have an account. That is stricter than the law requires of a game with no money in it, and it is deliberate: this is poker, and a poker table is not a place to put children.
If we learn that an account belongs to somebody under 18, we close it and delete the data behind it.
You sign in with a code we email you rather than with a password. Whoever can read your email can ask for that code, so the security of your account rests on the security of your mailbox — see the privacy notice, which says the same thing about the same mechanism.
One account per person. Do not share it, and do not make a second one to get back into a club you were removed from.
Give an address you can actually read. It is the only way into your account, and an address that bounces is an account nobody can get back into — including us.
A club is run by whoever made it. They decide who is let in, who is removed, and how many chips people start with. We do not arbitrate between members of a club, and we do not restore chips.
Owning a club means being responsible for what happens in it. A club used for harassment, for wagering, or for anything illegal will be closed.
Report any of it at the abuse page. We can suspend an account or close a club without notice where it is warranted.
Your display name, your avatar and anything else you upload remain yours. You give us only what running the service requires: permission to store it, to show it to the people in the clubs you are in, and to include it in a hand that somebody in that hand chooses to share. That permission lasts as long as the content is on PKWAT, costs nothing, and is used for nothing else — no advertising, no resale, no training anything.
Upload only what you have the right to upload. If a photograph, a logo or a name is not yours to use, it does not become yours by being here.
The name PKWAT, the interface, the artwork and the software behind it belong to Nendo. Using the service does not grant a licence to copy, adapt or redistribute any of it.
PKWAT is provided as it is, with no promise that it will keep running. It can change or stop. Hands in progress can be lost to a restart, a bug or a network failure, and because the chips are play money that is an annoyance rather than a loss. Where a club or an account is on a paid plan, we owe it the plan it paid for; where the service is free, it is free.
We may add, change or remove features at any time, including ones a club has come to rely on. Where a change would lose data, we will say so in the app first.
You can delete your account at any time from your account settings, and take your data with you first.
Most of PKWAT is free. A club or an account can buy a plus plan, which raises what it is allowed — more members, more games at once, a club's own background and logo. It buys room and appearance. It never buys an advantage: the chips, the shuffle, the clock and the seats are the same for everybody, paid or not, and that is not going to change.
Club Plus is €90 a year and Account Plus is €19 a year. Prices include VAT. Payment is taken once a year and renews for another year unless you cancel. We email you 45 days before each renewal, so a renewal is never the first you hear of it.
You can cancel at any time, from the same settings you bought it in, without asking us. Cancelling stops the next renewal and nothing else: the plan runs to the end of the year you have already paid for.
If you change your mind within 14 days of buying, write to hello@pkwat.com saying so and we refund the whole amount. You do not have to give a reason and you do not have to use a particular form of words.
When a plan ends — cancelled, refunded, or because a payment stopped — the club or account drops back to free and keeps everything it already has. Nobody is removed from a club, no game is closed and no history is deleted. What changes is that it cannot add more, and a club's own background and logo go back to the default. We do not trim a club to fit.
Prices can change. A change applies from your next renewal and never to a year already paid for, and we will tell you before it does.
We can suspend an account or close a club when one of the rules above is broken, when we are required to by law, or when leaving it running would put other people at risk. Where the situation allows it we say why and give you a chance to answer; where it does not — an attack in progress, a threat, something illegal — we act first.
If your account is closed for one of those reasons you may not open another. If you think we got it wrong, write to us and say so; a person will read it.
PKWAT costs nothing and carries no guarantee of availability, of accuracy or of fitness for any purpose. We are not liable for chips lost to a bug or an outage, for what other members of a club do, or for a club being closed by its own owner.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow to be limited. Where liability can be limited, it is limited to the fullest extent French law permits. For anything you have paid for, that limit is what you paid us in the twelve months before the problem.
These terms can change. Material changes will be announced in the app before they take effect, and continuing to use PKWAT afterwards means accepting them. If you would rather not, delete your account — the same settings page does it, and nothing is held back.
These terms are governed by French law. They are published in five languages; the French version is the one that binds if a translation and it ever disagree.
If you are a consumer, none of this takes away a right the law of the country you live in gives you, including the right to bring a dispute before the courts there. For anybody who is not a consumer, the courts of Paris have jurisdiction. Either way, write to us first — most of what reaches a court could have been settled by an email.
